In our last article, we discussed how the Georgia General Assembly has enacted major legislative updates aimed at strengthening property rights, increasing financial transparency, and providing essential safeguards for residential property owners. Two landmark pieces of legislation—House Bill 220 (enacted in 2024) and Senate Bill 406 (the Georgia Property Owners’ Bill of Rights Act, signed into law in May 2026)—fundamentally reshape how Homeowners Associations (HOAs) operate and protect homeowner interests.

Our HOA Bylaws needs amendments to reflect the latest changes in the laws that have passed and are going in effect on January 1st, 2027. I have spent a few months on working on this project. We will present 3 documents at the upcoming Annual Meeting of the Members.

  1. Red Line Version – This contains strikeouts and added language all in red font color.
  2. Legal Comment Version – This will contain the key changes needed with legal remarks.
  3. Proposed Draft Version – Amended sections will be all in green font color.

In the next few articles, we will examine each Bylaws Article in detail. Let’s start with Article I, General.
